I heard, I read, It happened ...

mooli parathas

Mooli Parathas

....to me! Plagiarism is by no means a new phenomenon - it happens all around us all the time. I have heard about it on several other blogs. Manisha of Indian Food Rocks has tons for information on what to do and how to prevent plagiarism. Nevertheless, when it happened to me, I was shocked. Even more shocked because the site in question was India Times!

The above picture from an earlier post was published by India Times/Economic times as part of their article "Food to lift your spirits" on 18th December 2006. They did not contact me for authorization to use my picture or acknowledge the source in their article. In fact unless you read closely there does not appear to be any connection between the picture and their article and I fail to understand why they would need a plagiarized picture when a stock image would have served the purpose.

One of my readers (thanks Maya!) alerted me to this or I would not have been aware that my work was being published elsewhere. I have sent a polite email to several links provided on their website, but haven't received any response yet.

This is the 4th time one of my pictures is being used. It was used as a picture for "Recipe of the week" by SIFY at food.sify.com before this and they did not even bother to respond to my "nice" email informing them that they were using a copyrighted image. The other 2 cases were individual blogs and they removed the picture once they were informed. [No, neither of them apologized]

I know 'tis the season and everything, but really! Whatever happened to common courtesy?

Happy Holidays everyone!

Edit 12/21/06 : And another one! This time it is a picture of a plate of poha that has shown up here!

WOW!! Saffron, what the heck?! It's your photo indeed!! I checked every nook and cranny. It is your's!! It is a little scary.Indians don't care about responding either, because they are not scared of getting sued!! What do we do? Some people are so shameless! I am so sorry about this and I do understand the frustration. You cannot do anything other than letting them know:(

Don't get this down during this time though Saffron.Enjoy the season.Happy Holidays to you.

When you work for free for the common interest and someone takes your ideas for profit, you should threaten to sue, agree a settlement and give the proceeds to charity. Menu for Hope would be a great idea.

But as Asha said, don't let this get you down. Good to see you back.

This is disgusting SH! I can understand if people do it out of ignorance, but to have actual journalists cross the line is intolerable!

I've had something similar happen to me recently as well, but fortunately it got cleared. It's quite sad people refuse to respect others' work, and unlike what Trig said, I threatening them won't do any good.

Try to keep your spirits up, and if you wish, do drop me an email and maybe we can try to come up with some kind of a solution for this nonsense.

Happy holidays!!

I've had similar problems, with my photos and text being copied without my permission. When a polite request fails (and that is always my first step), it can help to contact their ISP and inform the ISP that there's a copyright violation. This only works for US, French, and South Korean ISPs, though (and maybe others, though Chinese ISPs notoriously don't give a damn).

Alternatively, if the site runs Google ads, you can report the copyright violation to Google, as that is a violation of their policies. That should cut into the violator's revenue stream and hit 'em where it hurts.

Wow, that's not nice. As an avid photographer myself, I feel the need to protect my work [even though I'm not a pro at it yet]. I recommend dropping a watermark on your images..unsightly, maybe but at least no one will use it [We're hoping]. You could use the photoshop features to fade the text.

At Tue Dec 19, 09:31:00 PM 2006, Anonymous Manisha said...

Why? Because they're lazy. Because they assume that copyright does not apply to images. Because they think they can get away with it. Because - and I hate to say this - these are things that are not given due importance in India.

Invisible digital watermarking is one way of protecting your images. It does not detract from the beauty of the image. Stock photo sites use visible watermarks on their images so that thumbnails or smaller size images are not copied. If you have a small visible copyright in a corner on the image, it won't do much good. It only gives you some peace of mind - beyond, that it's very easy to crop it out.

This is not the first time the Times Group has stolen images. And this is not the first time that a company - not an individual - has violated copyrights. I ran into something similar last week and the problem had not been completely resolved the last time I checked. And it was content being copied word for word.

What is coming through is that we can fight this as a community - if we alert one another to it. Mythili started a Yahoo! Group and you can join by following the instructions here. The last I heard from Mythili she was affected by the storm in Seattle and was one of the several hundreds of thousands without power. So give her time to respond if you do join.

When it comes to individuals, I am more than willing to give them the benefit of the doubt. But when companies start copying our content and our images, it's time to take action as a community.

SH, your pictures are beautiful and I hope the Times Group has the decency to take your image off and take this opportunity to teach their employees some very very basic rules in journalism.

Hi SH,

I agree with all of you, but I want to state that internet is the last place on earth where you expect people not to plagarize. The poor law enforcement in the 3rd world will always work against you. I suggest you use something that prevents copying/prinitng. What's out online is kind of everyone's property.. if copyright infringement was that big a problen, china wudn't have been a big economy. This may sound harsh, but the fact of the matter is if it matters to you a lot then prevent copy of images technically else just put stuff up there. I love your site and I truly detest what has happened. I know I sound like a harsh critic, but to put things in perspective, product desing and features are being stolen by third world.. so are product/process patents in the health care industry.. then why do you expect pictures not to be stolen?

I really think u should watermark your pictures. Anyone will lift pictures from your site bcos your pics are simply amazing. It takes sometime to watermark, but it is worth the effort. Please consider it.....

The Times Group is notorious for lifting not just pictures but entire articles. One of the reasons I discontinued subscribing to TOI a couple of years back (bad copy being another - pun intended). Just this week I happened to read the "Weekend Supplement" that comes on Fridays with TOI, and found entire articles, page after page after page, with no authors' names!! Some of them were actually well written! So it could not have been written by the teeny-boppers who masquerade as 'journalists' (my apologies to some of the young writers who put in their time to research and write properly - Kavya Viswanathan not with-standing - but that is another story altogether).

I hate to say it myself, but this is 'typically Indian'. Good writing (and pictures) takes time and who has that in the times of Page 3 taking over the entire TOI and the likes!

Just pass this post around and make sure that everyone knows what low-rats work for these papers/sites. Definitely, the Indian blogger community has to come together on this issue and find some actionable solutions. Frankly, this has happenned to so many people, I am at a loss as to why people are not coming together to fight this sort of plagarism.

I have sent this amil to them. Since I know neither your name nor your email address I could not be more specific.

Dear Madam / Sir

I have been a very regular reader of Vikatan for more than 10 years. After moving to the US, I have become a subscriber of vikatan.

I found one copyrighted picture being used without permission in your vikatan book / online edition - http://www.vikatan.com/aval/2007/jan/05012007/aval0101.asp .

This picture
http://www.vikatan.com/aval/2007/jan/05012007/p86a.jpg belongs to one blog friend of mine of http://saffronhut.blogspot.com .

She had blogged about a pickle recipe and taken this picture. You can find her article dated March 2nd 2006 - http://saffronhut.blogspot.com/2006/03/too-many-tomatoes-tomato-pickle.html.

As a publisher yourself, you know how valuable it is to a artist to steal their intellectual property without their knowledge.

Given the history of Vikatan and how big an organization it is, I hope you will give due respect & recognition to the original photographer of that photo and publish a note in your next issue saying that the picture belongs to SaffronHut

Best Regards
Revathi

The only way you could hold it back would probably be by "watermarking" your pics with your site url. I cannot guarantee that it won't be used, but the sites you mentioned are quite famous as far as I know. So I can say that they would really feel ashamed when their viewers see that they are using copyrighted stuff.

Even if it may not stop, atleast it would be good advertisement for you... So don't let it get you down :-)!!!

Nice Blog. Love all your recipes. Even I've been having the same problem as u are "Plagiarism" Even "Sify food" has one of my recipe published as one of their own recipe. Initially they had my recipe as contributors recipe. But some days later I saw that they published it as it was one of their own. I've sent couple of emails to them and then they corrected the problem. The whole experience was really mind upsetting.
